Acts of the Court

The court, after the opening of the proceedings, invites the plaintiff to correct or supplement the claim, if necessary, and also asks for the payment of the court fee. In the case of an action for pecuniary performance, the fee depends on the amount claimed. For non-pecuniary or other transactions, the fees are specified directly in the tariff list.

As we have already explained, it is necessary that the action contains the essential elements and the definition of the claim. If the court considers that the action does not meet these requirements, it may request that it be corrected or supplemented.

The court will also, after filing the claim, determine the court fee according to the fee schedule. In cases where the subject is a pecuniary transaction, the court fee is at least CZK 1.000, but usually 5% of the defendant's amount (for claims up to CZK 40,000,000). The special rate is intended for a number of specific claims, e.g. for an action for compensation for non-pecuniary damage up to CZK 200,000, the fee amounts to CZK 2,000, and above CZK 200,000 it is 1% of the amount sued.

The fee in connection with the proposal to initiate proceedings for the settlement of the joint property of the spouses is basically CZK 2,000, then CZK 5,000 is added for each property.
